Terms of Service

1. Acceptance of these terms

By accessing or using The Scout Crew (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms form a binding agreement between you and FOM Consulting, Inc., a Florida corporation doing business as The Scout Crew (“we,” “us,” or “our”).

2. Eligibility

You must be at least 18 years old and legally able to use cryptocurrency services in your jurisdiction to use the Service. You may not use the Service if you are located in a country sanctioned by the United States Office of Foreign Assets Control (OFAC) or otherwise restricted from receiving services under applicable law. You are solely responsible for ensuring your use of the Service complies with local law.

3. What the Service is

The Scout Crew is an independent, unofficial third-party research platform that aggregates publicly available on-chain, market, project, and social data about crypto assets and surfaces it through automated scoring, AI research agents, dashboards, and community tools. It is not affiliated with, endorsed by, or operated by the official SOSANA project or any token issuer covered by the Service.

4. Wallet authentication and account

The Service uses Solana wallet signatures to authenticate users. You are solely responsible for the security of your wallet, private keys, and seed phrases. We will never ask for your private keys or seed phrase, and we cannot recover access to a wallet you have lost control of.

You agree to provide accurate information when prompted (e.g., email address for renewal reminders) and to keep that information up to date. You may not use someone else’s wallet, impersonate another person, or operate multiple accounts to circumvent limits, abuse free credits, or evade enforcement of these Terms.

5. Subscriptions and payments

Paid features of the Service are sold as time-bounded subscriptions priced in SOSANA tokens. Subscriptions are paid on-chain by transferring SOSANA to a treasury wallet we control. Once a payment transaction is confirmed on the Solana blockchain, the blockchain transfer is final and irreversible. We cannot cancel, reverse, or charge back that transaction.

There is no automatic wallet debit. Each subscription purchase or renewal requires you to select a plan and separately approve a new SOSANA transaction in your wallet. We cannot initiate a transfer from your wallet. Monthly access lasts 30 days and annual access lasts 365 days unless the checkout clearly states otherwise.

Subscriptions are generally non-refundable, subject to the narrow exceptions in our Refund Policy and any rights that applicable law does not allow you to waive. You may mark a subscription not to continue from your account page; access remains active until its stated expiration date.

Free trials require no card or payment, expire automatically, and do not convert into paid access. Continuing after a trial requires a separate plan selection and wallet-approved SOSANA payment. Subscription pricing, tiers, and features may change. Changes will not retroactively shorten access you have already paid for. We do not guarantee uninterrupted availability of any specific agent, data source, score, dashboard, token coverage, or feature.

6. Risk acknowledgements

You understand that crypto assets are volatile and risky, and that you may lose money, including the full amount you put at risk. Research signals, AI outputs, rankings, probability estimates, token data, social metrics, community-loop estimates, and other Service outputs may be inaccurate, incomplete, delayed, stale, or wrong. No content on the Service is a promise or guarantee of profit, yield, token appreciation, reward, tax treatment, liquidity, listing, allocation, community payment, or other financial result. You are solely responsible for your wallet security, transactions, taxes, compliance, and decisions.

7. No investment advice or regulated service

The Service is not a broker, dealer, investment adviser, commodity trading adviser, exchange, custodian, bank, tax adviser, or law firm. We do not take custody of user funds, execute trades for users, manage portfolios, provide personalized investment recommendations, or decide whether you should buy, sell, hold, stake, transfer, or avoid any asset. Any examples, scores, agent responses, or dashboard projections are general research outputs and must not be treated as individualized advice.

8. Acceptable use

You agree not to:

• Scrape, mirror, redistribute, or resell content from the Service.
• Reverse-engineer, decompile, or attempt to derive source code from the Service.
• Use the Service to harass, defame, or harm others.
• Attempt to gain unauthorized access to other users’ accounts, data, or wallet activity.
• Interfere with the operation of the Service through abusive request volume, automated scripts, or denial-of-service activity.
• Use the Service to promote, facilitate, or coordinate market manipulation, wash trading, or any conduct that violates securities or commodities laws.
• Circumvent rate limits, paywalls, or other access controls.

9. User-generated content

The Service may let you submit content (e.g., intel submissions, support tickets, agent conversations). You retain ownership of what you submit, but grant us a non-exclusive, royalty-free, worldwide license to host, display, process, and moderate that content for the purpose of operating the Service. We may remove submissions that violate these Terms or applicable law at our discretion, without notice.

10. Our content and license to you

The Service, its software, design, branding, research methods, compilations, scores, reports, and original content are owned by us or our licensors and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own lawful, internal research. No sale or transfer of intellectual-property rights occurs. Third-party names, data, and content remain the property of their respective owners.

If you submit suggestions or feedback, you permit us to use them without restriction or compensation. Copyright concerns may be sent to support@thescoutcrew.com with identification of the work, the challenged material, your contact information, and a good-faith statement supporting the request.

11. Third-party services and links

The Service depends on blockchains, wallets, RPC providers, exchanges, market-data services, social platforms, AI providers, and external websites that we do not control. Their data, terms, availability, security, and conduct are their responsibility. Links and references do not constitute endorsement. You assume the risks of third-party services and must review their terms and privacy practices separately.

12. Termination

We may suspend or terminate your access to the Service at any time, without notice, if we reasonably believe you have violated these Terms, posed a security risk, or used the Service unlawfully. Termination for cause does not entitle you to a refund of any active subscription. You may stop using the Service at any time; if you have an active subscription, see Section 5 for what that means for refunds.

13. Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy of data, or uninterrupted availability. We do not guarantee that scores, signals, probability estimates, agent responses, or any other output will be accurate, complete, timely, or suitable for any decision.

14. Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, tokens, or trading positions, arising out of or related to your use of the Service — even if we have been advised of the possibility of such damages. Our total cumulative liability for any claim arising out of these Terms or the Service is limited to the amount you paid us in subscription fees in the twelve (12) months before the event giving rise to the claim, or USD $100, whichever is greater.

These exclusions and limitations apply only to the maximum extent permitted by law. They do not exclude liability that cannot lawfully be excluded or limit a non-waivable consumer remedy.

15. Indemnification

You agree to defend, indemnify, and hold harmless The Scout Crew and its operators, contributors, and affiliates from any claim, loss, or expense (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

16. Electronic records and acceptance

You agree to conduct this transaction electronically. By checking the legal acknowledgement box and selecting the continue button, you adopt that process as your electronic signature and agree to the linked legal documents. You can print or save them using your browser. We may retain your wallet-linked account, exact text, document versions, acceptance time, user-agent, IP address, and acceptance method as evidence.

You may withdraw consent to future electronic contracting by emailing support@thescoutcrew.com and discontinuing use. This does not undo prior transactions or acceptances. Because the Service is online-only, withdrawal may prevent continued use. We do not charge for an electronic copy requested by email.

17. Changes to these Terms

We may update these Terms at any time. Material changes will be reflected by updating the “Last updated” date at the top of this page and, where reasonable, by notice within the Service. For a material change, we may designate a new legal agreement version and require affirmative acceptance before continued member access. Changes do not retroactively alter completed purchases unless required by law or expressly agreed.

18. Governing law and disputes

These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-laws rules. Subject to any non-waivable rights under applicable law, any dispute arising under these Terms will be resolved in a state or federal court of competent jurisdiction in Florida, and you consent to personal jurisdiction and venue in those courts.

Before filing a lawsuit, each party agrees to send a written description of the dispute and requested resolution and allow 30 days for a good-faith informal resolution attempt. Notices to us go to support@thescoutcrew.com. This does not prevent urgent injunctive relief or an eligible small-claims proceeding, and it does not extend any legal limitations period.

19. General terms

These Terms and incorporated documents are the entire agreement concerning the Service. If a provision is unenforceable, it will be enforced to the greatest lawful extent and the remainder will continue. A failure to enforce is not a waiver. You may not assign these Terms without our consent; we may assign them with a reorganization, financing, merger, sale, or transfer of the Service. Provisions that by their nature should survive—including ownership, disclaimers, limitations, indemnity, and disputes—do.

We are not responsible for delay or failure caused by events outside our reasonable control, including blockchain congestion, wallet or provider failure, internet disruption, governmental action, natural disaster, labor dispute, or malicious attack. Section headings are for convenience only.
